Acceptance of These Terms

ExploreApps sp. z o.o. ("ExploreApps", "we", "our", and "us") provides our websites, mobile applications, products, and services (collectively, the "Services"), including those that offer voice-based, conversational, and other AI-powered features. All access to and use of the Services is subject to these Terms of Use.

By accessing, browsing, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services. We may modify these Terms at any time; your continued use after changes take effect indicates your acceptance. You also agree that your use complies with all applicable laws and regulations, including data protection laws (such as GDPR and CCPA) and emerging AI regulations.

The Services

The Services help you learn, practice, and interact through digital tools, some of which use voice input and AI to generate spoken and written responses. The Services are provided for personal, self-improvement purposes. They are notaccredited instruction, certification, or a substitute for a qualified professional, and they do not constitute professional, academic, legal, medical, or financial advice.

Specific features may be governed by additional terms posted within the Services; your use of those features indicates your acceptance of the additional terms.

Eligibility and Minors

You must be at least 13 years old to use the Services. If you are under 18, you may use the Services only with the verifiable consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for supervising your use. We may verify such consent and may suspend accounts that do not meet these requirements.

Registration, Account, and Security

You may need to register and provide true, accurate, current, and complete information; registration data is governed by our Privacy Policy. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of unauthorized use or any breach, and log out after each session. We are not liable for losses arising from your failure to comply.

Microphone and Voice Recording

Voice features require access to your device microphone, and the Services record your speech while a session is active in order to function. By using voice features, you consent to this recording for the purposes described in our Privacy Policy. If you do not grant or you revoke microphone access, voice features will be unavailable.

Nature of AI Output; No Professional Advice

Because the Services incorporate AI-generated content, you acknowledge that some outputs may be inaccurate, incomplete, or biased and should be used with caution. We make no warranty as to the legality, reliability, or suitability of any AI-generated content for a specific purpose. AI-generated content and recommendations do not constitute and are not intended to substitute for professional advice. You may not use the Services or outputs in regulated contexts (such as healthcare, finance, or education) without ensuring full compliance with applicable regulations and conducting independent verification.

Subscriptions and Purchases

Full use of the Services may require a purchase or subscription. Payments are charged via your app-store or platform account. Subscriptions renew automatically unless canceled in advance as required by the platform (for example, at least 24 hours before the end of the current period), and you may disable auto-renewal at any time. Available plans and prices are shown at the time of purchase, may vary by region, and are subject to change; the price displayed at purchase is final.

Acceptable Use

You are solely responsible for your use of the Services, including any content you submit and any outputs you use, distribute, or share. You must ensure your use complies with applicable laws, third-party rights, and ethical standards. You agree not to use the Services or outputs to:

• violate intellectual property or proprietary rights;
• upload malicious code or anything harmful to devices or networks;
• create or disseminate content that violates privacy or security rights, including recording or sharing other people's voices or personal information without their consent;
• distribute unsolicited advertising, spam, or fraudulent schemes;
• generate unlawful, harmful, abusive, defamatory, hateful, discriminatory, sexual, or otherwise objectionable content, including in any interaction involving minors;
• impersonate others or misrepresent affiliations;
• solicit personal information from minors;
• harvest or distribute personal information without consent;
• promote illegal activities
• circumvent content protections or geographic restrictions, including VPN misuse;
• use data mining, scraping, or automated extraction without permission;
• use the Services or outputs to develop or train competing AI technologies;
• attempt to circumvent blocks or restrictions we impose.

We may remove content and suspend or terminate users who violate these Terms, and report violations to authorities where required by law.

Your Content and License

You retain ownership of the content you submit, including your voice recordings and conversation content ("Your Content"). You represent that you hold or have obtained the rights necessary to submit Your Content and that it does not violate laws or third-party rights.

You grant ExploreApps a worldwide, royalty-free license to host, process, and use Your Content solely to operate, secure, improve, and support the Services. We do not publicly share your voice recordings or conversation content, and we do not use them to train generalized AI models without your separate, informed, and explicit consent. We may monitor, edit, remove, or disclose content where necessary to comply with law, enforce these Terms, or protect rights and safety.

Any feedback you provide is non-confidential and may be used by us without obligation or compensation.

Intellectual Property

The Services and their content and features ("Service Content") are protected by copyright, trademark, and other laws. Except as expressly authorized, you agree not to modify, copy, frame, scrape, rent, lease, sell, distribute, sublicense, or create derivative works based on the Service Content. The ExploreApps name and logos are trademarks and service marks of ExploreApps; nothing herein grants you a license to use them without prior written permission.

We are not liable for third-party content, including other users' content. We do not pre-screen content but reserve the right to remove or refuse any content that violates these Terms or applicable law. You bear the risks related to use of such content.

Disclaimer of Warranties

Your use of the Services and any output is at your sole risk. The Services and output are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We make no warranty that the Services will meet your requirements; be uninterrupted, timely, secure, or error-free; or that results obtained will be accurate or reliable.

Limitation of Liability

To the maximum extent permitted by law, ExploreApps shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, or loss of profits or data, arising from your use of or inability to use the Services or outputs. Under no circumstances will ExploreApps' total liability exceed US$100. Some jurisdictions do not allow certain limitations, so some may not apply to you.

Modifications, Data Retention, and Availability

We may modify, suspend, or discontinue the Services (or parts) at any time, with or without notice, without liability. We do not guarantee the storage, backup, or availability of any content or outputs; you are responsible for maintaining your own copies. Inactive accounts may be permanently deleted after 90 days of inactivity without prior notice.

Export Compliance

You agree to comply with all applicable export and re-export control laws. You represent that you are not located in, or a citizen or resident of, any country or territory subject to comprehensive sanctions or export restrictions, and that you will not use the Services for any prohibited end-use.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict-of-law provisions. You agree to submit to the exclusive jurisdiction of the courts having jurisdiction over the registered seat of ExploreApps for the resolution of any disputes arising out of or relating to these Terms or the Services.

Severability and Entire Agreement

If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions remain in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ExploreApps with respect to the Services and supersede all prior understandings.
